Job Description  

The Nature’s Bounty Co. is seeking a legal counsel adept in handling employment and litigation legal assignments. In this position, you will provide legal advice and carry out actions which have an impact upon the rights, privileges and responsibilities of the Company while maintaining high standards of legal and business ethics and professional responsibility. This role will be a key member of our litigation legal team – focused primarily on assignments relating to both employment advice and consultations, as well as actual and potential disputes that become the subject of formal court or administrative agency procedures as assigned – reporting to the Deputy General Counsel Litigation. In addition, in certain instances, the position may require handling of certain transactional or compliance related matters, including contract review. Responsibilities include, but are no limited to:

  • Provide counsel on employment related matters, which may include, but not limited to, human resources issues, wage and hour law, workers’ compensation, unemployment and other state agency claims, labor relations, employee benefits, employment agreements and policy related issues, FMLA matters, employment related litigation, grievances and arbitrations and generally assists the Deputy General Counsel and the Human Resources Department.
  • Identify and assess legal risks and opportunities within the labor and employment area and advise accordingly.
  • Provide high quality oral and written legal advice in a cost-effective manner to internal clients. 
  • Manage disputes that become the subject of formal court or administrative agency procedures in a hands-on manner to achieve cost-effective and desired results, either directly or through outside counsel.
  • Represent clients before Federal, State and Local courts, administrative agencies and/or other forums generally with limited supervision. 
  • Perform or provide advice in connection with internal investigations.
  • Evaluate potential litigation matters and advise on exposure.
  • Work with business units to resolve disputes without litigation. 
  • Assist in providing internal training and policy development to management to reduce unnecessary litigation. 
  • From time to time may assist transactional or compliance related matters, including contract review and drafting.
  • Provide advice regarding the implications of laws substantially impacting the Company's business; anticipate legal issues and encourage practices to prevent problems from arising.
  • Regular interface with a highly collaborative and interactive legal / business teams.
  • Maintain current knowledge of legal issues and developments in the law.

Qualifications  
  • Four or more years as in-house, Litigation/Employment Counsel for a $500,000,00+ top-line Sales Company, publicly traded in the U.S.A. or four (4) or more years of experience in the Litigation Department/Employment of a law firm (or combination thereof).
  • Five years or more of total professional experience practicing law after graduation from law school.
  • Experience in providing employment advice and dealing with employment related litigation is required.
  • Exposure to a wide range of federal, state, and local labor and employment laws, including, but not limited to Title VII, ADA, ADEA, FMLA, FLSA, New York State and statutes and regulations, and other labor and employment laws regarding hiring, termination, discipline, discrimination, retaliation, wages, and other key areas is preferred.
  • Exposure to commercial or advertising litigation is valued.
  • Knowledge/experience related to contract drafting or ethics and compliance matters is a plus.
  • Prior exposure to the expectations of large, wholesale customers from the Food, Drug and/or Mass Market trade with respect to quality, delivery and information exchange would be valued.
  • J.D. degree from a well-recognized and fully accredited law school
  • Must be admitted to the bar in New York as a member of good standing
  • Collaborative and a team-oriented approach, and capable of building strong, strategic relationships.
  • Excellent oral and written communication skills.
  • Demonstrated ability to conduct research and analysis of legal issues.
  • The ability to acquire an understanding of the unique challenges encountered by companies which deal directly and indirectly with end-use customers of ingestible Consumer Packaged Goods.
